Ressourcenallokation im Recht
Leiterin: Alice Bertram, Fachbereich Rechtswissenschaft, Freie Universität Berlin; Institutionelle Anbindung der X-Student Research Group: Fachbereich Rechtswissenschaft, Freie Universität Berlin
The research project takes up the questions of distributive justice as a core issue of jurisprudence and examines them using current examples of resource allocation. On the one hand, natural resources are considered against the background of climate change and their legal regulation in public law. Here, the question of allocation concerns in particular the equitable distribution of resources between present and future generations. Second, data as a resource in private law are examined. The basic question of the equitable distribution and allocation of data has not yet been resolved. This is where conventional legal institutions - such as property - reach their limits. The examination of both areas is intended to broaden the view of the nature and function of resources in law and is aimed at developing a jurisprudential concept of resource oriented towards established theories of justice.
